1.簡述意識形態的經濟功能。
答:任何一種意識形態都是在其載體和主體——某一特定團體的實踐過程中形成的,也是為該團體的整體利益服務的。在社會經濟過程中,任何個人、團體的目標首先是保護自己的既有利益,其次是實現既有利益的增長。在實現這兩個目標的過程中,意識形態具有下列幾個基本經濟功能:
(1)保護團體內部團結和穩定
任何一種意識形態都是作為某個團體的意識形態存在的,是團體成員共有的。因為它是團體成員共同擁有的認知體系,所以它有助于團體成員彼此達成認識上的一致與行動上的統一,有利于保護團體內部的團結和穩定性。
(2)論證團體集體行動的合理性
在經濟生活中,任何團體采取的集體行動都不是盲目的、無意識的,是受其意識形態影響甚至支配的。意識形態的論證功能表現為兩方面:
①對團體成員來說,使之確信采取與集體一致的步驟和做法是合理的、正義的、應該的,由此實現團體內部成員間的團結協作;
②對其他團體以至整個社會來說,意識形態的作用在于使特定團體的行為披上代表全社會利益的外衣,證明其行動的目標和方法的合理性,減少其他團體的抵觸和敵對,盡量爭取全社會的認同和支持。從這個角度講,任何一種意識形態都不會公開聲稱本團體行為的自我效用,而是強調團體行為具有普遍的效用,能夠帶來整個社會,乃至全人類共同的福利提高。
(3)動員團體全體成員采取集體行動,已實現行動的規模經濟
意識形態的動員功能表現為兩方面:
①激發起所有成員的信心和熱情,堅定實現行動目標的決心;
②使團體的長遠目標對團體成員來說更具吸引力、說服力,以獲得所有成員的支持,做出短期利益的犧牲。團體中少數優秀分子和領導人物他們就可以通過團體內部機制,如宣傳機制、示范機制來鼓動團體成員,采取集體行動。
(4)約束團體成員的行為,減少“搭便車”現象的出現
該功能是D.諾斯反復強調的,也是其意識形態理論的核心。諾斯認為,意識形態指的是所有人解釋他們周圍世界時所擁有的主觀信念(即模型和理論)。無論在個人相互關系的微觀層次上,還是在有組織的意識形態的宏觀層次上,它都提供了對過去和現在的整體性解釋。正因為如此,意識形態能夠修正個人行為,減少集體行動中的“搭便車”問題。
(5)規范團體之間的關系
社會中存在著不同利益取向的團體。這些團體之間的關系在社會經濟生活中或者是相互寬容、合作,或者是彼此對立排斥。團體只見這種關系的形成,除開其他原因,意識形態是一個重要原因。作為認識和解釋世界的工具,每個團體的意識形態都有一套符合本團體利益的信念與價值。由于各自利益取向的不同,勢必造成各團體意識形態的差異。這種差異反過來進一步影響著基于利益取向的團體間關系。但意識形態的規范功能不是最終決定性的,只是一種觀念力量發揮著對物質力量的反作用。
2.簡述行政法的基本原則。
答:行政法的基本原則,是貫穿于全部行政法律規范之中、調整和決定行政主體全部行為的基本準則。行政法的基本原則有:
(1)行政合法性原則
行政合法性原則是指行政權的設立、行使必須依據法律,符合法律要求,不能與法律相抵觸。行政合法性原則要求行政主體必須嚴格遵循行政法規范的要求,不得享有行政法規范以外的特權,超越法定權限的行為無效;違法行政行為依法應受到法律制裁,行政主體應對其行政違法行為承擔相應的法律責任。行政合法性原則的具體要求有:①任何行政職權都必須基于法律的授予才能存在;②任何行政職權的行使應依據法律、遵守法律,不得與法律相抵觸;③任何行政職權的授予和委托及其運用都必須具有法律依據,符合法律宗旨。
(2)行政合理性原則
行政合理性原則是指行政機關不僅當按照法律、法規規定的條件、種類和幅度范圍作出行政決定,而且要求這種決定應符合法律的意圖和精神,符合公平正義等法律理性。行政合理性原則中的“理”是指體現全社會共同遵守的行為準則的法理。行政合理性原則的具體要求有:①行政行為的動因應符合法律目的;②行政行為應建立在正當考慮的基礎上,要有正當的動機;③行政行為的內容應合乎情理。
3.解釋拉姆齊法則的含義。
答:拉姆齊法則是指在政府不能征收歸總稅的前提下給出了對不同需求彈性的商品如何征稅才能做到效率損失最小的原則。該法則包含的法則有:
(1)邊際稅收效率損失相等原則
該原則又稱效率損失最小的原則,可以表述為要求邊際稅收的效率損失相等,只要從某種商品征得的最后一單位稅收引起的效率損失大于其他的商品,那么就還有可能通過改變征稅辦法降低效率損失,只要適當降低該商品稅率,提高其他商品稅率,就能夠實現效率損失最小化。
(2)逆彈性法則
為保證效率損失能夠最小,該法則要求,兩種商品的稅率應與其需求彈性成反比。
(3)等比例遞減法則
做到效率損失最小并不要求對不同的商品課征統一的稅率,而是要求使不同的商品稅后需求量的變動比例能夠統一。
4.公共選擇和私人選擇在哪些方面有所不同。
答:(1)公平政策過程的性質
公共部門決策涉及公民團體、立法機構、執行部門、規章制定委員會、企業及其他利益相關者之間的博弈、妥協和沖突。對產品和服務的單個生產者和消費者而言,他們的利潤或福利并不能得以最大化。無數的具有相互分歧和沖突的價值觀的利益相關者的存在,使公共部門的選擇比私人部門要復雜。
(2)公共政策目的的集體性
公共部門的政策目的是集體性目的,應反映社會的偏好和更為廣泛的“公共利益”。正如我們已經看到的,這些集體性目的涉及從效益、效率、充分到公平、反應性和適當性等多重標準的沖突。
(3)公共物品的性質
公共和私人物品可分為三類:特定物品、集體物品和準集體物品。特定物品是排他的。因為擁有它們的個人有法定的權利排除他人從中受益。特定物品(如汽車、住房或醫生的服務)的分配常常以供求關系決定的價格為基礎。集體物品是非排他-的,因為它們被每一個人消費。沒有一個人能被熱電廠排除在清潔空氣、水和政府提供的道路的消費之外。而由于公共領域內供與求的正常關系通常不起作用,所以不能以市場價格為基礎對集體物品進行分配。準集體物品是其生產對社會有重大外部效應的特定物品。盡管基礎教育可由私人部門提供,其外部效應如此之大,以至政府要在所有人能承受的成本范圍內創建大量的公立學校。

答:政治權力是指在政治關系中,權力主體依靠依靠一定的政治強制力,為實現某種利益而作用于權力客體的一種政治力量。
(1)按照政治權利主體的性質可以把政治權力劃分為原始社會的政治權力、奴隸主階級的政治權力、封建主階級的政治權力、資產階級的政治權力和無產階級的政治權力。
(2)按照政治權力主體的組織類型差異,政治權力主要可以劃分為社會公共權力和執政黨權力。社會公共權力是指全社會范圍內的政治權力,是以全社會成員的共同利益即社會共同利益為基礎的政治權力。執政黨權力是指特定階級或階層的政治組織的政治權力,其形成的基礎是特定階級和階層的共同利益。
(3)按照政治權力主體的層級,可以將政治權力劃分為中央權力和地方權力、上級權力和下級權力。中央權力是特定政治權力主體內部最高層次上的權力,是同一政治權力中的核心部分。地方權力是特定政治權力主體體系內部次級層次上的權力,是按照政治地域的劃分而形成的權力。上級權力與下級權力是在相互對應關系中形成的,一般來說上級權力層次高于下級權力,作用范圍大于下級權力并處于對下級權力的統率和領導地位上。
(4)政治學中的政治權力功能類型通常是指社會公共權力的功能類型,按其不同功能,社會公共權力大體上可以分為立法權、行政權和司法權。立法權是社會公共權力中制定、修改或廢止法規、法案的權力。行政權是社會公共權力中實施法案、管理社會行政事務的權力。司法權是社會公共權力中實施法律并以此為標準規范社會生活的權力。

答:政治冷漠是指公民對于政治問題和政治活動冷漠而不關心,不參加政治活動,政治冷漠是消極的政治態度在政治行為上的表現。有些學者認為一定程度的政治冷漠有利于政治制度的運作,主要原因在于:
(1)鼓勵那些對政治不熟悉、沒有興趣的人去參與政治,對社會沒有什么好處
這些人可能會對自己及社會的最高利益有錯誤的判斷,他們也可能對民主的含義不甚理解,容易受錯誤導向的影響,為嘩眾取寵但不合適當領導的人所吸引。因而,鼓勵這些人參與政治會在實際上對民主造成破壞。
(2)堅持認為每個公民都要參與政會導致以對民主的忠誠情感代替了對民主的理性判斷
政治不可能是純功利主義的,情感取向和功利主義的結合才能實現政治系統的平衡。如果對政治系統的關心完全建立在實用主義基礎上,那么這種基礎是不穩定的。同樣,對政治系統的情感承諾過于強烈,也會對民主造成不利的影響:①感情強烈的政治參與容易主張難以控制的政治運動,造成政治動蕩;②一個政治系統中的很多團體若獲得情感過于強烈的承諾,可能會導致系統的分裂,所以公民要保證控制所屬團體的主動權;③政治系統的平衡有賴于主動性和被動性的平衡狀態,而具有強烈情感色彩的政治參與就可能打破這種平衡狀態。
(3)一些選民無法具備政治判斷所需要的實際政治知識
即使在最理想的政治條件下,一些選民也不會具有進行復雜的政治判斷所需要的實際政治知識。
這是精英民主主義者的一種代表性觀點。熊彼特認為,公民之間不可能就應當實現的公共利益達成一致意見;從每個人意志出發的政治決定,并不一定能代表所有公民的意志;由于公民對政治問題往往容易產生超理性的乃至非理性的偏見和沖動,因此在危急時刻這些因素對于他的國家也許是致命的。
(4)廣泛的政治活動存在著不利的因素
廣泛的政治活動,從某些方面看是可取的,但也有不利的因素。太活躍的團體會妨礙統治者去做他們最有能力去做的事情,公共議事日程會被扭曲。而且,高度自治化的團體還會導致過多的爭論、分裂和不穩定。政治興趣和政治積極性的驟然上升,可能預示著政治制度中的動亂或危機的到來,或新的嚴重分裂的出現。所以,民主制度的正常運作通常需要某些個體和群體的某種程度上的冷漠和回避。不積極參與政治的邊緣人口的存在是不民主的,但這也正是使民主有效地發揮作用的原因之一。

經濟發展提高了國民財富和教育程度,為人們提供了在社會地位較高的職業中就業的機會,也就會增強人們的參與意識和參與能力。
②經濟發展使公民訴諸政治行為來維護并進一步實現自身利益
譬如在利益關系的變化中,新的利益群體的出現,使現存群體受到某種威脅,不同群體之間就有可能產生某種利益關系的緊張。這種緊張關系又使各個群體內部產生群體意識,從而導致群體求助于政治權力,采取集體行動來與其他群體競爭,以擴大和維護自身的權益。
③經濟發展同時也促使政府職能擴大,要求提高政治參與程度
政府職能擴大意味著政府擴大了其在社會中的作用,受到政府作用影響的公民違反過來影響政府作用,就不得不提高參與程度。政府活動愈影響公民及其群體,這些公民或公民構成的群體就愈是覺得政府與自己的目的相關,就愈積極努力的去影響政府構成和決策。
④經濟社會發展促進了公民的國家意識
對公民個人來講,經濟發展使個人與民族國家的關系變得日益重要,這就無形之中增加了每個公民的國家意識。而現代國家意識很重要的一個方面就是公民對于國家的權利和義務感。由權利和義務共同構成的公民概念,為大眾性政治參與奠定了廣泛基礎。
(2)政治參與對社會經濟發展的影響
①公民參與的成本——效益選擇,可以影響到經濟政策中的資源配置與社會效果,決策中的選擇與結果直接掛鉤,會迫使公職人員的政策行為合乎經濟效益的原則。
②帶有支持性的政治參與能夠加強政府或執政黨推進經濟增長政策的力量
由于經濟增長與社會的活力是分不開的,政治參與從這個意義上具有對于經濟發展效率的積極作用。政治參與不僅溝通了公民與政府間的信息交流,而且還促使了公民許多直接利益的實現。因此,它既可集思廣益,實現公民政治權利,調動公民的政治積極性,又可提高公民對政治權力及其行為的滿意程度,從而為經濟發展提供了動力源。

A Successful Student

關于教職工攻讀學位、培訓及進修的規定
(2009年10月修訂)
為進一步提高我校教職工隊伍的整體素質,改善教職工的學歷結構,提高教學科研和管理水平,適應學校不斷發展與創新的需要,同時進一步規范教職工攻讀學位、培訓及進修的管理工作,特作如下規定:
一、報考國內培養的碩士生、博士生
(一)報考條件
1. 專職教師和科研人員報考在職研究生,一般需入校工作滿一年,專職輔導員和教輔、管理人員報考在職研究生,一般需入校工作滿二年。
2. 符合國家關于報考研究生的政治、業務、身體和年齡等條件。
3. 政治思想表現好,工作認真負責,能較好地履行本崗位職責。
4. 所申請報考的學校和專業,必須是教育部承認的。
5. 學校要求的其他條件。
6. 有下列情形之一的人員,不予批準報考:
(1) 不能履行崗位職責,上年度考核為基本合格、不合格的人員;
(2) 近三年內出現教學事故;
(3) 近三年內受過黨紀政紀處分的人員;
(4) 其他不允許報考的人員。
(二)報考類型
1.專職教師和科研人員原則上只可報考在職培養的研究生;報考國家統分研究生的須調離學校,未滿服務期的須繳納違約金。
2.專職輔導員、教輔和管理人員原則上只可報考與從事崗位相關的專業,若報考本校研究生,須服從所在部門和研究生部統籌安排,并且不得占用本校計劃內招生指標。
(三)學習期間的管理
1. 在職培養的研究生要承擔學校分配的教學、科研和管理等任務,參加學校、學院等組織的政治、業務學習活動等。
2. 在職學習的研究生,每年應以學年總結的形式向所在單位匯報自己的學習情況及成績。
3. 學習期間不得隨意變更學習專業和學習院校。
4. 在學習期間符合相應專業技術職務任職條件的,可以按學校規定參加專業技術職務的評聘。
5. 在職在崗培養的研究生在學習期間可享受工資、崗位津貼,根據年度考核情況發放績效津貼;在職脫產(定向\委托)培養的研究生在脫產學習期間停發工資和崗位津貼,待回崗工作后補發工資,崗位津貼不予補發, 根據年度考核情況發放績效津貼。
(四)培養經費和服務期
1. 我校在編在崗的教職工,凡經學校批準,經研究生考試合格,被錄取為博士研究生,學費由學校承擔50%,個人承擔50%,最多可報銷人民幣50,000元;被錄取的碩士研究生,學費由學校承擔30%,個人承擔70%,學校最多可報銷人民幣20,000元。
2. 錄取時,先由個人交付學費,在畢業取得相應學位后,憑畢業證書與學位證書、學費收據和人事處批準備案表等由學校按比例返還。
3. 在職攻讀研究生課程班、本科及本科以下學歷的人員,費用全部自理。
4. 財務獨立核算的部門,其職工發生的上述學費由本部門和職工本人參照上述比例自行承擔。
5. 由學校或部門報銷經費的研究生,畢業后須延長在學校的服務期,在取得碩士學位后應在學校服務滿三年,取得博士學位后應在學校服務滿五年;未滿服務期調離、辭職等,須向學校返還學校已經承擔的學費和相關費用。
(五)報考程序
1.報考人員到人事處網站下載《對外經濟貿易大學教職工報考研究生申請表》(一式二份)。
2.所在部門領導在《對外經濟貿易大學教職工報考研究生申請表》上簽署意見、蓋章。
3.將《對外經濟貿易大學教職工報考研究生申請表》報人事處簽署意見,未經人事處簽署意見的,不予報銷相關學費。
4.憑錄取通知書到人事處簽訂培養合同。
二、進博士后流動站
根據全國博士后管理委員會關于博士后入站條件的相關規定,我校在編在崗的專職教師申請入博士后流動站工作,原則上須將人事關系調離學校,未滿服務期的,須繳納違約金。
三、國內非學歷培訓
1.為提高教職工在某領域的專業技能,學校組織該領域的人員參加非學歷培訓。
2.各部門、個人的非學歷培訓計劃要符合學校的總體思路和統一安排,要有詳細的培訓方案、內容、日程安排等,每年年底前各部門將下一年度的非學歷培訓計劃報人事處審核,經主管校領導批準后,正式列入學校職工培訓年度計劃后方可組織實施。
3.經學校批準的培訓計劃由學校支付培訓經費,為合理安排我校職工培訓經費開支,各部門培訓經費報銷的比例由人事處實行總量控制。
4.各類國家規定的崗位資格培訓(教師資格除外)和工人技術等級考核培訓,其培訓經費一律由個人自行承擔。
5.未經學校批準的部門、個人的培訓經費由本部門或個人支付。
6.財務獨立核算的部門,其部門或職工發生的上述培訓經費由本部門自行解決。
四、公派出國進修
1. 我校教職工公派出國進修的遴選工作由人事處會同有關單位共同開展。
2. 出國人員的政治審查、派遣、逾期處理等工作由人事處負責;各學院、其他處室和個人不得擅自派遣人員出國進修,否則將追究相關責任人的行政責任。
3. 出國進修人員回國后一周內憑學習期滿證明文件等有關書面文件到人事處報到,在回國后一個月內要寫出進修報告,交學院(所)審查備案。
4. 出國進修三個月以上的人員,停發國內工資,按期回國后予以補發。在國外進修期間,停發崗位酬金和校內其他薪酬,回國后不予補發。
5. 公派出國進修人員,須持學校批件到人事處辦理相關手續,簽訂協議。
6. 出國進修人員延長在學校的服務期:在外進修滿六個月者,須自回國報到之日起在校服務滿一年;在外進修滿一年者,須自回國報到之日起在校服務滿兩年;在外進修一年以上者,須自回國報到之日起在校服務滿三年。
7. 出國進修逾期不歸人員按照學校(96)外經貿學人字第052號及相關文件按自動離職或除名處理。
五、國外學歷教育
國外學歷教育的費用,除了與學校有協議約定的,按照約定辦理,否則由本人負擔,學校不負責報銷。
六、自費留學
自費出國人員原則上應與學校脫離工作關系,調離學校,未滿服務期的須繳納違約金;待學成回國后根據本人意愿和學校發展需要,雙向選擇,重新就業。具體規定按照國家有關規定執行。
七、附則
1.此規定不包括中層干部和黨員非學歷培訓。
2.本規定自公布之日起執行,在本規定公布之前已經攻讀或攻讀完相關學位的人員按照(外經貿學人字(2007)057號)文件執行。
3.本辦法由人事處負責解釋。
